These Terms and Conditions apply to all services provided by Holland Hire, operating as a Dutch uitzendbureau / detachering company, registered in the Netherlands.

By using our services or website, you agree to these Terms.

Holland Hire operates as an intermediary for the supply of labour in accordance with Dutch law.

2. Nature of Services

Holland Hire provides temporary staffing and detachering services.

  • Workers are employed by Holland Hire under Dutch employment contracts.
  • Workers are temporarily assigned to clients (hirers) for specific assignments.
  • Holland Hire remains the legal employer of the workers at all times.

Holland Hire does not operate as a freelance, gig, or self-employment platform.

3. Employment Relationship

All workers supplied by Holland Hire:

  • Are employed under Dutch labour law.
  • Receive employment contracts (e.g. temporary or on-call contracts).
  • Are paid through payroll in compliance with tax and social security laws.

Holland Hire complies with:

  • Waadi (Wet allocatie arbeidskrachten door intermediairs)
  • WAB (Wet arbeidsmarkt in balans)
  • Applicable Collective Labour Agreements (CAO)
  • Dutch and EU employment legislation

4. Client Obligations

Clients agree to:

  • Provide a safe and healthy working environment (Arbowet).
  • Treat Holland Hire workers equally to their own employees (equal pay and working conditions).
  • Comply with all applicable labour, health, and safety regulations.

Clients may not directly employ or engage Holland Hire workers during or after an assignment without written agreement.

5. Working Hours & Assignments

  • Assignments are temporary and based on availability.
  • Holland Hire does not guarantee continuous work unless legally required.
  • Working hours depend on client demand and worker availability.

6. Invoicing & Payment

  • Clients are invoiced based on approved worked hours.
  • Payment terms are agreed contractually (usually 14 or 30 days).
  • Late payments may result in interest or suspension of services.

7. Liability

  • Holland Hire is responsible for employment obligations.
  • Clients remain responsible for day-to-day supervision and workplace safety.
  • Holland Hire is not liable for indirect or consequential damages.

8. Termination

Holland Hire may terminate assignments or agreements:

  • In case of non-payment.
  • In case of legal or compliance violations.
  • If continuation is no longer commercially or legally feasible.

9. Governing Law

All agreements are governed by Dutch law. Disputes shall be submitted to a competent Dutch court.
